Distance Sales Contract

1. Parties

This Distance Sales Contract ("Contract") is made between:

By accepting this contract, the BUYER agrees to pay the full order amount and any applicable additional fees such as shipping and tax upon order confirmation.

2. Subject

This contract governs the sale and delivery of the product(s) ordered electronically by the BUYER from the INTERMEDIARY, in compliance with Turkish Consumer Law No. 6502 and the Distance Contracts Regulation.

4. General Terms

- Buyer confirms all pre-sale information and terms.
- Delivery within 7–14 days based on location; not exceeding 30 days.
- INTERMEDIARY is not liable if recipient refuses delivery.
- Buyer must inspect items upon delivery and request damage reports if needed.
- Order is valid only after payment confirmation.
- INTERMEDIARY is not liable for unauthorized use of payment methods.
- Buyer must return item within 3 days if payment is reversed.
- Refunds require accurate IBAN submission by Buyer.
- Legal compliance and notification addresses are as stated.
- Minors and legally incapacitated individuals cannot place orders.
- This contract is effective upon electronic approval by the Buyer.

5. Right of Withdrawal

- No withdrawal for auctioned or winning bids (personal sales).
- Withdrawal possible within 14 days only in case of wrong or defective product.
- Buyer must notify INTERMEDIARY in writing.
- Products must be returned unused, undamaged, with all packaging and accessories.
- Buyer compensates for any loss in product value due to misuse.

6. Exceptions to Withdrawal

No right of withdrawal for:
- Market-fluctuating priced goods
- Personalized/custom goods
- Perishable goods
- Unsealed hygiene-sensitive items
- Mixed goods that can’t be separated
- Opened digital/software/media products
- Periodicals (unless by subscription)
- Time-specific services (accommodation, transport, etc.)
- Instant electronic services or digital delivery
- Services commenced with consumer approval before withdrawal period ends

7. Default

In case of delay, the Buyer is responsible for bank interest and legal fees per their card agreement. INTERMEDIARY reserves the right to claim damages from delayed payments.

8. Jurisdiction

Disputes will be resolved through Consumer Arbitration Committees or Consumer Courts within the monetary limits set annually by the Turkish Ministry of Trade.
